RECOMMENDATION:
1.      Approve a request for a Special Use Permit to allow the Intero Montessori School at the northwest corner of Van Buren Street and Sarival Avenue, within the Canyon Trails Phase One Planned Area Development (PAD) zoning district, subject to stipulations.
 
2.      Approve a Clarification Agreement between the City of Goodyear and the Land Owner regarding the West Van Buren Street and North Sarival Avenue right-of-way improvements.
 
PURPOSE:
The Special Use Permit is being requested to allow the Intero Montessori School on a 12.16 acre parcel within Canyon Trails Phase I at the northwest corner of Sarival Avenue and Van Buren Street.
 
The Clarification Agreement is needed to clarify the stipulation related to the obligation to construct half-street improvements to North Sarival Avenue and West Van Buren Street along the frontage of the parcel being developed.  The agreement clarifies that certain portions of the half-street improvements to North Sarival Avenue and West Van Buren Street along the frontage of the parcel being developed have been completed and the obligations with respect to the half-street improvements is limited to constructing the improvements needed to complete the half-street improvements and that the plans for the improvements have to be consistent with the City's CIP project for improvements along Sarival Avenue and West Van Buren Street.
